Emails often feel more casual than letters and seem to live in the space between speaking and writing. We tend to write emails with less formality, less grammar, and less care, but our recipients judge our emails like writing. Email mishaps, including those of our clients, often turn into a treasure trove for plaintiff and defense counsel alike. This presentation will explore common issues in every day email that lands clients, and attorneys, in hot water, and will instruct attendees on how proper email etiquette can be used to avoid future legal issues – from addressing an email, to figuring out what to include (and what not to include), to proofreading it, and, finally, the hardest thing of all … knowing when you shouldn’t send one, including the risks involved should you chose to do so.
