 If you are a client looking for information on holding a mediation with the Chester County Bar Association's Mediation program, please visit this page.  

Thank you for your interest in being a part of the CCBA's Mediation Program. To participate in this program, you must have attended specialty mediation training and have submitted your proper documentation to us for approval. If you still need to attend training, we have a sample list of providers below. You are not restricted to these providers and can use another program if you wish. You should also be familiar with the mediation program agreement that both parties will be required to sign before beginning the mediation process.

The Mediation Procedure

Mediator Requirements 

The requirements for joining the CCBA's Mediation Program are as follows:

  1. Have completed at least 40 classroom hours of basic mediation skills training including instruction in communication skills, negotiation skills, conflict resolution, the mediation process, ethical issues and role-play as a mediator and as a party to the conflict. The training should be provided by a nationally recognized provider of mediation training or provided by one or more “Experienced Mediator(s)”.1
  2. Have within the past five years either (i) observed in the aggregate at least 5 mediations conducted by an “Experienced Mediator” and in addition mediated at least 5 mediations with discussion after each mediation session with an “Experienced Mediator” or (ii) mediated at least 15 mediations with at least 20 hours of actual mediation.
  3. Have a Juris Doctor or an equivalent degree, five years’ experience as an attorney and be a member of the Chester County Bar Association.
  4. Provide annual, written proof that the individual maintains a current policy of professional liability insurance, which includes mediation as a covered area.
  5. Complete and provide to the CCBA the “Mediator Certification Form “certifying to (1), (2) and (3) above and provide the proof required by (4) above. Additionally, the prospective mediator shall identify the types of conflicts that he or she would not be willing to mediate under the Mediation Program.   6. Each year, individuals on the mediator list will be expected to attend a minimum of four hours of continuing education relating to mediation, at least one hour of which will be a program (approved by the ADR Section of the CCBA or such other approver as the CCBA from time to time may designate) the objective of which will be to promote Mediation Program uniformity.2

1 For the purposes of this program, Experienced Mediator shall mean be a person who has received at least 40 hours of education in basic mediation skills and has mediated at least 200 hours. Mediation shall mean a consensual process in which an impartial party (the Mediator) facilitates communication between conflicted parties (the Parties) to aid the Parties in resolving the conflict. Mediators do not have authority to make decisions or impose a solution on the Parties. The fundamental principle of Mediation is the self-determination of the Parties.
2 For the purposes of fulfilling the Mediator Certification requirements, viewing the video of the required annual one-hour CCBA program will constitute attendance.
